A+Me Terms and Conditions

Welcome to A+Me! These Terms and Conditions ("Terms") govern your access to and use of the A+Me website, mobile applications, and all related educational services, courses, and content (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By creating an account, purchasing a course, or otherwise using the Services, you confirm that you have read, understood, and agree to these Terms. If you are under the age of 18, you must have your parent or legal guardian review and agree to these Terms on your behalf before using the Services. In accordance with the Protection of Personal Information Act (POPIA), the registration of a minor requires the explicit consent of a parent or legal guardian.

2. Description of Services

A+Me provides online educational courses, tutoring materials, and related content designed to assist students in their academic studies. Our Services include video lessons, practice problems, study guides, and other educational resources.

3. No Guarantee of Academic Results (Disclaimer)

Please read this section carefully.

A+Me is committed to providing high-quality educational content and resources to support student learning. However, we do not guarantee, represent, or warrant that the use of our Services will result in any specific academic outcome, grade, test score, or admission to any educational institution.

Specifically, we do not state or imply that completing an A+Me course or using our tutoring materials will guarantee a student an "A+" or any other specific grade in their school exams or standardized tests. Educational success depends on numerous factors beyond our control, including but not limited to the student's individual effort, prior knowledge, study habits, and the specific requirements of their school or testing board. The Services are provided as a supplementary educational tool and should not be considered a substitute for formal schooling or a guarantee of academic success.

4. User Accounts and Registration

To access certain features of the Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. License to Use the Services

Subject to your compliance with these Terms and payment of any applicable fees, A+Me grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for your personal, non-commercial, educational purposes.

You may not:

  • Reproduce, distribute, publicly display, or publicly perform the Services or any content therein.
  • Modify, adapt, or create derivative works based on the Services.
  • Use the Services for any commercial purpose or for the benefit of any third party.
  • Share your account credentials with others.

6. Intellectual Property Rights

All content, materials, trademarks, logos, and intellectual property associated with the Services, including but not limited to video lessons, text, graphics, and software, are the exclusive property of A+Me or its licensors. You acknowledge that you do not acquire any ownership rights by using the Services.

7. User Conduct

You agree not to use the Services to:

  • Violate any applicable local, state, national, or international law or regulation.
  • Transmit any material that is abusive, harassing, tortious, defamatory, vulgar, pornographic, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Interfere with or disrupt the Services or servers or networks connected to the Services.
  • Attempt to gain unauthorized access to any portion of the Services or any other accounts, computer systems, or networks connected to the Services.

8. Payments, Subscriptions, and Refunds

If you purchase a course or subscription, you agree to pay all applicable fees. In accordance with Section 44 of the Electronic Communications and Transactions Act (ECTA), you are entitled to a seven (7) day cooling-off period from the date of purchase or conclusion of the agreement, during which you may cancel the transaction without reason or penalty. All other fees are non-refundable unless otherwise stated in our specific Refund Policy or required by applicable law. We reserve the right to change our pricing and subscription models at any time, with notice to you.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. A+ME DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL A+ME, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

11. Indemnification

You agree to defend, indemnify, and hold harmless A+Me and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

12. Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Services.

13. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Services shall be brought exclusively in the Magistrate's Court or High Court of South Africa (Western Cape Division), as applicable, having jurisdiction over Stellenbosch, South Africa. You hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms.
